2. Reporting Intellectual Property Infringement to KeenTail

If you believe that any material or content on the KeenTail website or services infringes your intellectual property rights (including copyright, trademark, or patent), please send a formal notice of infringement to our legal department. To ensure a prompt and effective response, your notice must include the following information:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the intellectual property right that is allegedly infringed.
  2. Identification of the copyrighted work(s), trademark(s), patent(s), or other intellectual property claimed to have been infringed (e.g., "XYZ copyright," "ABC trademark, Reg. No. 123456, registered 1/1/20XX," "Patent No. XXXX").
  3. A description of where the allegedly infringing material is located on the KeenTail site, including specific URL(s) or other information reasonably sufficient for us to locate the material.
  4. Information reasonably sufficient to allow KeenTail to contact you, such as your full legal name, company affiliation (if applicable), mailing address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use of the material is not authorized by the intellectual property owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the intellectual property owner or authorized to act on behalf of the owner whose exclusive right is allegedly infringed.

Upon receipt of a complete and valid infringement notice, it is KeenTail's policy to promptly investigate the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material.

3. Counter-Notice Procedure

If you believe that material you posted on the KeenTail website was removed or disabled as a result of mistake or misidentification of the material, you may send a counter-notice to our legal department. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access has been disabled.
  3. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, to any judicial district in which KeenTail may be found, and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.
